Welcome to ModU! These Terms of Service ("Terms") govern your use of the ModU Discord bot ("the Bot", "we", "our", or "ModU"). By adding ModU to your Discord server or using any of its features, you agree to be bound by these Terms.

1. Acceptance of Terms

By inviting ModU to your Discord server or using any of its features, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use ModU.

You must also comply with Discord's Terms of Service and Community Guidelines at all times.

2. Eligibility

To use ModU, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal authority to accept these Terms
• Have proper permissions to add bots to the Discord server
• Comply with Discord's Terms of Service
• Not be prohibited from using Discord or ModU under applicable laws

3. License and Use

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use ModU for its intended purpose within Discord.

3.2 Acceptable Use

You agree to use ModU only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use ModU to violate any laws, regulations, or Discord's Terms of Service
• Attempt to reverse engineer, decompile, or extract source code from ModU
• Use ModU to harass, abuse, or harm others
• Attempt to gain unauthorized access to ModU's systems or databases
• Use ModU to spam, phish, or distribute malware
• Exploit bugs or vulnerabilities for malicious purposes without reporting them
• Resell, redistribute, or sublicense ModU's services
• Use ModU in a manner that could damage, disable, or impair the bot's functionality
• Attempt to circumvent rate limits or restrictions

4. Bot Features and Functionality

4.1 Available Features

ModU provides various features including but not limited to:

• Server moderation tools (kick, ban, mute, warn, etc.)
• Automated moderation (AutoMod)
• Welcome messages and member management
• Auto-role assignment
• Invite tracking
• Web dashboard for configuration

4.2 Modifications to Service

We reserve the right to modify, suspend, or discontinue any feature of ModU at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the service.

4.3 No Guarantee of Uptime

While we strive for high availability, we do not guarantee that ModU will be available at all times. The bot may experience downtime for maintenance, updates, or due to circumstances beyond our control.

5. User Responsibilities

5.1 Server Ownership and Permissions

As a server owner or administrator using ModU:

• You are responsible for configuring ModU appropriately for your server
• You must ensure your use of ModU complies with Discord's Terms of Service
• You are responsible for moderating your server and using ModU's tools responsibly
• You must not use ModU to violate the rights of your server members

5.2 Account Security

If you use ModU's web dashboard:

• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access
• You are responsible for all activities that occur under your account

6. Data and Privacy

Our collection and use of data is governed by our Privacy Policy. By using ModU, you consent to our data practices as described in the Privacy Policy.

• We do not sell your data to third parties
• You can request data deletion by removing the bot or contacting us

7. Intellectual Property

7.1 Ownership

ModU, including its code, design, features, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

7.2 User Content

You retain ownership of any content you input into ModU (e.g., custom messages, configurations). By using ModU, you grant us a license to use, store, and process this content solely to provide the bot's services.

8. Prohibited Conduct

The following conduct is strictly prohibited:

• Abuse and Harassment: Using ModU to harass, bully, or abuse others
• Illegal Activity: Using ModU for any illegal purpose
• Hate Speech: Configuring ModU to promote hate speech or discrimination
• Spam: Using ModU to send unsolicited messages or spam
• Exploitation: Exploiting bugs or vulnerabilities for personal gain
• Impersonation: Impersonating ModU staff or other users
• Service Disruption: Attempting to disrupt or damage ModU's services

9. Termination

9.1 Termination by You

You may stop using ModU at any time by removing the bot from your server.

9.2 Termination by Us

We reserve the right to suspend or terminate your access to ModU at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Violation of Discord's Terms of Service
• Abusive or malicious use of the bot
• Legal or security concerns

9.3 Effects of Termination

Upon termination:

• Your access to ModU will be revoked
• Your data may be deleted in accordance with our Privacy Policy
• Provisions that should survive termination (e.g., disclaimers, limitations of liability) will remain in effect

10. Disclaimers and Limitations of Liability

10.1 "As Is" Service

ModU is provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties that ModU will meet your requirements

10.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or server content
• Loss of profits or revenue
• Service interruptions or downtime
• Actions taken by moderators using ModU
• Any damages arising from your use or inability to use ModU

Our total liability shall not exceed $100 USD or the amount you paid to use ModU (if any), whichever is less.

10.3 User Responsibility

You acknowledge that:

• ModU is a tool, and you are responsible for how you use it
• We are not responsible for moderation decisions made using ModU
• You should have backup moderation methods
• No automated system is perfect, and manual oversight is recommended

11. Indemnification

You agree to indemnify, defend, and hold harmless ModU, its developers, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of ModU
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of Discord's Terms of Service

12. Discord Integration

ModU is a third-party bot and is not affiliated with, endorsed by, or sponsored by Discord Inc. Your use of ModU must comply with:

• Discord Terms of Service
• Discord Community Guidelines
• Discord Developer Terms of Service

13. Pricing and Payment

ModU is currently free to use. If we introduce premium features in the future:

• We will provide advance notice of pricing changes
• Continued use after price changes constitutes acceptance
• Refund policies will be clearly stated
• Free features may remain available

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. For material changes, we may provide additional notice:

• Announcement in our support server
• In-bot notification
• In our website
• Top.gg announcements feed

Your continued use of ModU after changes constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

15.2 Dispute Resolution

In the event of a dispute:

• Contact us first to attempt informal resolution
• If unresolved, disputes may be subject to binding arbitration
• You waive the right to participate in class action lawsuits

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ModU.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

16.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.
